1. DEFINITIONS

  • “Company” refers to NADZA Photography
  • “Client” refers to the individual or entity booking photography services
  • “Session” refers to the scheduled photography appointment
  • “Package” refers to the selected service tier and inclusions
  • “Deliverables” refers to the final edited photographs provided to the Client

2. BOOKING AND CONFIRMATION

2.1 Booking Process

  • Step 1 – Initial Request: Client must complete booking form via company website or WhatsApp link
  • Step 2 – Availability Check: Company reviews requested date and time slot availability from booking form
  • Step 3 – Pencil Booking: If client’s requested date and time are available, company makes a temporary reservation.
  • Step 4 – Final Reservation: To secure the exact date and time slot, the client must pay an AED 100 booking confirmation fee (this amount will be deducted from your total package cost)
  • Booking Status: Only bookings with the AED 100 payment received are considered confirmed and reserved
  • Pencil Booking Expiry: Unpaid pencil bookings expire after 48 hours, and the slot becomes available to other clients

2.2 Booking Confirmation and Payment Schedule

  • Booking Confirmation: AED 100 required to secure date and time slot (forms part of total package cost)
  • Balance Payment: Remaining package cost due immediately after session completion, same day on location
  • Payment Methods: Cash or bank transfer accepted
  • Booking Fee Refund Policy: AED 100 is fully refundable if cancellation notice given more than 48 hours before scheduled session
  • Late Payment: Balance must be settled before leaving session location

3. PRICING AND PACKAGES

3.1 Package Inclusions

  • Each package includes specified number of professionally edited photographs
  • Session duration as outlined in package details
  • Basic props and backdrop options included
  • Detailed package information provided upon inquiry

3.2 Additional Services

  • Extra outfit changes: AED 50 per additional outfit beyond package allowance
  • Additional backdrop setups: AED 50 per setup beyond package allowance
  • Extended session time: AED 50 per additional 30-minute block
  • Rush delivery (24-48 hours): AED 100 for complete order, AED 20 per individual photo
  • Additional edited photos: AED 20 per photo beyond package allowance
  • Professional retouching upgrade: AED 20 per photo (includes advanced skin work, background cleanup, and detailed corrections)

4. PHOTO DELIVERY AND SELECTION

4.1 Preview and Selection Process

  • Unedited preview gallery provided within 48 hours of session
  • Client has 9 days to make final photo selections
  • Failure to respond within 9 days grants Company discretion in photo selection

4.2 Final Delivery

  • Standard delivery: 3-5 business days after selection confirmation
  • Express delivery: 24-48 hours (additional fees apply)
  • Delivery format: High-resolution JPEG files via secure download link
  • File access: Download links remain active for 9 days

4.3 Photo Storage and Retention

  • Unedited photos retained for 9 days after session date
  • Final edited photos backed up for 27 days
  • Raw files available for purchase (AED 200 for complete session) within 9-day window

5. EDITING AND RETOUCHING SERVICES

5.1 Standard Editing Includes

  • Color correction and enhancement
  • Lighting adjustments
  • Contrast and exposure optimization
  • Basic cropping and composition refinement

5.2 Premium Retouching Includes

  • Professional skin smoothing and blemish removal
  • Hair and clothing cleanup
  • Background enhancement
  • Advanced facial and body contouring
  • Teeth whitening and eye enhancement

5.3 Revision Policy

  • One round of minor revisions included per photo at no charge
  • Major revisions or additional rounds: AED 20 per photo
  • Revision requests must be submitted within 3 days of delivery

6. SCHEDULING AND PUNCTUALITY

6.1 Client Responsibilities

  • Arrive fully prepared with all outfits, accessories, and styling complete
  • Arrive on time to maximize session duration
  • Communicate special requests or concepts at least 48 hours in advance

6.2 Late Arrival Policy

  • 0-15 minutes late: Full session time honored
  • 15-30 minutes late: Session time reduced accordingly
  • 30+ minutes late: Session may be cancelled with 50% fee retention
  • No-show: Full payment forfeited

6.3 Rescheduling Policy

  • More than 48 hours notice: Up to 2 free rescheduling opportunities
  • Less than 48 hours notice: No cancellation refund, but may use the 2 free rescheduling opportunities instead
  • Third rescheduling attempt: AED 100 fee applies
  • Emergency rescheduling: Considered on a case-by-case basis due to unforeseen circumstances

7. CANCELLATION AND REFUND POLICY

7.1 Client Cancellation

  • More than 48 hours before session: Full refund including AED 100 booking confirmation payment
  • Less than 48 hours before session: AED 100 booking payment forfeited, but client may use 2 free rescheduling opportunities instead of losing payment
  • No-show without prior notice: AED 100 booking payment forfeited with no rescheduling options
  • Used both reschedule opportunities: Any subsequent cancellation results in forfeiture of AED 100 booking payment

7.2 Company Cancellation

  • Full refund provided if Company cancels for any reason
  • Alternative session dates offered when possible
  • Company not liable for indirect costs or expenses

8. USAGE RIGHTS AND INTELLECTUAL PROPERTY

8.1 Company Rights

  • Company retains copyright to all photographs
  • Company reserves right to use photographs for:
    • Portfolio and website display
    • Social media marketing
    • Print and digital advertising
    • Professional competitions and exhibitions

8.2 Client Opt-Out Rights

  • Clients may opt out of marketing usage by providing written notice before or during session
  • Opt-out requests honored without penalty or additional charges
  • Company may still use images for internal portfolio purposes

8.3 Client Usage Rights

  • Clients receive unlimited personal use rights for delivered photographs
  • Commercial use requires separate licensing agreement
  • Clients may not alter, edit, or manipulate final photographs without permission

9. LIABILITY AND INDEMNIFICATION

9.1 Limitation of Liability

  • Company liability limited to total amount paid for services
  • Company not liable for indirect, consequential, or incidental damages
  • Client acknowledges photography involves inherent risks

9.2 Equipment and Property

  • Company not responsible for damage to client’s personal items
  • Client responsible for any damage to Company equipment or studio property
  • Professional insurance coverage maintained by Company

9.3 Force Majeure

  • Neither party liable for delays or failures due to circumstances beyond reasonable control
  • Includes weather, natural disasters, government actions, or health emergencies
  • Alternative arrangements made when possible

10. PRIVACY AND CONFIDENTIALITY

10.1 Data Protection

  • Client personal information handled in accordance with applicable privacy laws
  • Information used solely for service delivery and legitimate business purposes
  • Client contact details not shared with third parties without consent

10.2 Session Confidentiality

  • All session activities and discussions treated as confidential
  • Professional discretion maintained regarding all client interactions

11. QUALITY GUARANTEE AND SATISFACTION

11.1 Service Standards

  • Professional quality guaranteed for all delivered photographs
  • Technical issues with final images will be corrected at no charge
  • Client satisfaction is a priority; concerns addressed promptly

11.2 Dispute Resolution

  • Good faith effort to resolve any concerns through direct communication
  • Mediation available through agreed-upon neutral third party
  • Jurisdiction: Dubai, United Arab Emirates

12. GENERAL TERMS

12.1 Entire Agreement

  • These terms constitute the complete agreement between parties
  • Modifications must be in writing and signed by both parties
  • Supersedes all prior agreements or understandings

12.2 Severability

  • If any provision is deemed invalid, remaining terms remain in full effect
  • Invalid provisions replaced with nearest valid equivalent

12.3 Governing Law

  • Agreement governed by laws of the United Arab Emirates
  • Disputes subject to jurisdiction of Dubai courts

13. HEALTH AND SAFETY

13.1 Studio Safety

  • Clients must follow all safety instructions and guidelines
  • Company maintains comprehensive health and safety protocols
  • Any injuries must be reported immediately

13.2 Health Considerations

  • Clients with health conditions that may affect session should inform Company in advance
  • Reasonable accommodations provided when possible
